SATELITE DISHES – PERMANENT FIXTURES?
When concluding an offer to purchase for immovable property, the question often arises whether a satellite dish must be regarded as a permanent fixture or not.
A strong argument can be made in favour of a non-permanent fixture, if it is not specifically stipulated in the agreement of sale:
- The satellite dish can be easily removed and is regarded as an accessory to the remote satellite dish decoder.
- A satellite dish is still regarded as a luxury item in most homes and therefore not a standard fitting to every home.
- Accordingly the seller can remove the dish when he vacates the property.
If it is the seller and purchaser’s intention that the dish remains, best is to stipulate same in the agreement of sale.
This underlines the importance of listing permanent fixtures to a property in the deed of sale carefully to avoid any unnecessary confusion or conflict which might delay or derail the sale of the property.
